RECENT NOTABLE LEGAL DEVELOPMENTS
In First National Bank v. DDS Construction, 2011-C-1418 (La. 1/24/12), the Louisiana Supreme Court rules that an act cancelling a mortgage can be corrected by a notarial acto fo correction under La. R.S. 35:2.1 with retroactive effect.
In Oubre v. Louisiana Citizens Fair Plan, 2011-C-97 (La. 12/16/11), the Louisiana Supreme Court reinstated a trial court's award of $92,865,000 against Louisiana Citizens Property Insurance finding that an insurer is liable for failing timely to initiate adjustment of a claim of a catastrophic loss without regard to good or bad faith.
